Messaging (SMS) Policy

EverSparc, LLC ("BossCrew," "we," "us," or "our") operates the BossCrew platform at bosscrew.com. This Messaging Policy describes the SMS (text-message) programs we operate and how you can manage your participation. It supplements our Privacy Policy and Terms of Service.

1. Two distinct SMS programs

BossCrew sends or facilitates SMS in two distinct contexts. Each has its own consent model and opt-out path.

1a. The BossCrew Platform SMS Program

Messages we (BossCrew) send to you, our customer — the business owner or team member who holds a BossCrew account. Examples include:

  • Account verification (one-time passcodes / two-factor authentication)
  • Security alerts (new device sign-in, password reset)
  • Billing notifications (failed payment, plan changes, upcoming renewal)
  • Operational alerts (service degradation, scheduled maintenance)
  • Onboarding messages during your first 30 days

How you opt in. By providing your mobile number during account signup, in your profile settings, or when you enable a specific feature (such as two-factor authentication), you consent to receive transactional SMS from BossCrew at that number for the purposes listed above.

1b. End-Customer Messaging Operated by Our Customers

BossCrew also provides a Messaging feature that lets our customers (businesses on the BossCrew platform) send SMS to their own customers (the homeowners and clients they serve). Examples include:

  • Appointment confirmations and reminders
  • Job-status updates (such as "technician en route")
  • Estimate and invoice delivery
  • Review requests after a completed job
  • Two-way conversational messages between a business and its customer

Sender of record.When a BossCrew customer sends a message to their customer, that BossCrew customer is the sender of record under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and equivalent state laws. BossCrew acts as a service provider that transmits the message on the customer's behalf, but the legal obligation to obtain prior express consent from the message recipient rests with our customer. Each BossCrew customer must register their own brand and campaign through The Campaign Registry as part of A2P 10DLC compliance, and must collect and document consent before adding a recipient to any messaging audience. We provide tooling inside the BossCrew platform to capture and store that consent.

2. Message frequency

Message frequency varies based on your account activity and the programs you opt into. Platform messages (program 1a) are typically fewer than 10 per month for an active account, plus event-driven alerts. End-customer messages (program 1b) are determined by the BossCrew customer operating that program.

3. Charges

Message and data rates may apply. SMS messages are charged by your mobile carrier in accordance with your wireless plan. BossCrew does not charge a per-message fee to end recipients.

4. How to stop messages (opt-out)

You can stop messages at any time by replying with any of the following keywords to any BossCrew SMS:

  • STOP
  • CANCEL
  • UNSUBSCRIBE
  • QUIT
  • END

We will send one final confirmation message acknowledging the opt-out, after which you will not receive further messages from the same sender on that number unless you opt back in.

If you opt out of messages sent by a BossCrew customer (program 1b), that opt-out applies to messages from that specific BossCrew customer. To opt out of additional senders, reply STOP to messages from each. To opt back in after opting out, reply START or UNSTOP to the same number, or contact the sender directly.

6. Carriers and delivery

BossCrew uses Twilio as its SMS delivery provider. Messages are delivered through US mobile carriers (AT&T, T-Mobile, Verizon, and their MVNO partners) and are subject to those carriers' delivery practices, throughput limits, and content policies. BossCrew is not liable for messages that are delayed or undelivered due to carrier conditions outside our control.

7. Privacy and mobile information sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that support our messaging operation (for example, our SMS delivery provider, Twilio) is permitted because it is necessary to deliver the message you have requested. All other categories of personal data may be shared with third parties only in accordance with our Privacy Policy; mobile opt-in data and SMS consent records are excluded from any such sharing.

Mobile opt-in data and consent records are retained for the duration of your relationship with BossCrew (or the BossCrew customer who collected the consent) plus a four-year audit-retention period required by US carrier compliance, after which they are deleted in line with our standard data-retention practices described in the Privacy Policy.

8. Eligibility and consent

You must be the account holder of the mobile number you provide, or have the account holder's permission, before opting that number in to any BossCrew SMS program. By opting in, you represent that you have such authority. You must be at least 18 years of age to consent to receive SMS messages from BossCrew.

9. Changes to this policy

We may update this policy from time to time. Material changes will be notified via email to active account holders and posted at this URL at least 30 days before they take effect. Continued use of BossCrew SMS programs after the effective date constitutes acceptance of the updated policy.
